Carson Wrongful Death Lawyer

Reviewed by David Gammill, California trial attorney · Last reviewed: September 24, 2026

When a death in Carson is caused by someone else’s negligence, California law gives specific family members a wrongful death claim, and it gives the person’s estate a separate survival claim. Both carry deadlines. Gammill Law Accident & Injury Lawyers is a South Bay trial firm that handles wrongful death cases in Carson and across the South Bay. The firm has recovered more than $100 million for California clients across verdicts and settlements. Its results include a $21.1 million wrongful death verdict, a $16 million school sexual abuse verdict, and a $12 million whistleblower retaliation verdict; every case is different, and prior results do not guarantee a similar outcome.

What a Wrongful Death Claim Is in California

A wrongful death claim is the civil case a family brings when a death was caused by someone else’s negligence or wrongful act. It is separate from any criminal case. A prosecutor decides whether to charge a driver; your family decides whether to hold the driver, the company that employed the driver, or the public agency that maintained the road responsible for the loss. The two cases run on different tracks, and a family can recover in the civil case whether or not a prosecutor ever files a charge. The claim exists to answer for what the family lost, and California law is specific about who may bring it and how long they have.

Who Can File: CCP § 377.60

California limits who may bring a wrongful death lawsuit. Under Code of Civil Procedure § 377.60, the claim belongs to the surviving spouse or registered domestic partner, the children, and, if there are no surviving children, the people who would inherit under California’s intestacy rules. Parents and stepchildren can join the case if they were financially dependent on the person who died. If you are not on the statute’s list, you cannot file, no matter how close you were.

This matters in practice, because every eligible family member should be part of one lawsuit. California treats wrongful death as a single action, and a relative left out of it can lose the right to recover. Our companion guide on when to file a California wrongful death lawsuit applies the deadline to a death, and we make sure the right people are named from the start.

Two Claims, Not One: Wrongful Death and the Survival Action

Most families are surprised to learn that a death usually produces two separate legal claims. The wrongful death claim belongs to the family. It compensates the survivors for what they lost: the financial support the person would have provided, the value of household services, funeral and burial expenses, and the loss of the person’s love, companionship, comfort, care, protection, guidance, and moral support. California does not cap these damages in an ordinary negligence case.

The survival action belongs to the estate. Under Code of Civil Procedure § 377.34, it recovers the losses the person suffered before death, such as medical bills and lost wages between the injury and the death, and it is the claim that can carry punitive damages. For survival actions filed on or after January 1, 2026, it no longer recovers the person’s own pain and suffering; a temporary law that had allowed it expired without renewal. Where a driver was drunk or grossly reckless, Civil Code § 3294 allows punitive damages through the survival action on clear and convincing proof, though they are never guaranteed.

Fatal Crashes and Deaths in Carson: What the Record Shows

The 405 through Carson is its own universe of numbers. Between Wilmington Avenue and Main Street, a study using University of California, Berkeley crash data, reported to the Metro board, counted 4,335 injury collisions, including 201 severe injuries and 48 deaths, from 2019 through 2023. Caltrans records for the same stretch show rear-end and sideswipe crashes were about three-quarters of all collisions between April 2020 and March 2023, the pattern of congested weaving between closely spaced interchanges. The freeway is Caltrans property, and the California Highway Patrol investigates a fatal crash on it. When a roadway’s condition or design was part of why someone died, a claim against the public entity is possible under Government Code § 835; that claim carries its own six-month deadline, which is one reason a fatal-crash investigation has to begin early, and the state may raise an immunity for the road’s design that has to be answered with evidence.

On Carson’s own streets, the honest answer is narrower. No public source counts how many people have died on the city’s local roads, so this page does not offer a number. What the state does publish counts people killed or injured together: in 2023, traffic collisions in Carson killed or injured 427 people, according to the California Office of Traffic Safety’s crash rankings, and that figure has risen in every reported year since 2019, from 279 in 2019 to 282 in 2021 and 325 in 2022. Of the 27 pedestrians killed or injured in the city that year, 7 were 65 or older, the 13th-highest count among 103 comparable California cities. Carson is a contract city with no municipal police force, so a fatal collision on a city street is investigated by the Los Angeles County Sheriff’s Department at the Carson Sheriff’s Station, 21356 South Avalon Boulevard, and a fatal crash on the freeway by the California Highway Patrol.

The Deadlines That Control a Carson Wrongful Death Case

Two years from the date of death. Under Code of Civil Procedure § 335.1, most California wrongful death lawsuits must be filed within two years. The clock runs from the death, not from the injury that caused it where the two fall on different days, and courts rarely excuse a missed deadline.

Six months when a public entity is involved. If a Caltrans freeway, a city street or signal, a county road, or a government vehicle played a role in the death, a written claim must reach the correct public entity within six months, before any lawsuit, under Government Code § 911.2. In Carson that usually means Caltrans for the 405, the 110, and the 91; the City of Carson for city streets and signals; and the County of Los Angeles for a Sheriff’s Department vehicle or for roads in unincorporated West Carson or Rancho Dominguez. Six months passes quickly after a death, and identifying the right entity is part of the work.

Where the case is heard. Carson sits in the South Central District of the Los Angeles Superior Court, so a Carson wrongful death lawsuit is filed and tried at the Compton Courthouse, 200 West Compton Boulevard; since 2022 the court has kept new personal injury and wrongful death cases in their local district courts from filing through trial.

How a Wrongful Death Case Is Proven

Every wrongful death case answers the same three questions: what happened, whose fault it was, and what the family lost. The evidence that answers them rarely waits. In a crash case that means the vehicles before they are repaired or scrapped, event data recorders, camera footage from nearby businesses and intersections, and witness accounts taken while memories are fresh; in a commercial truck case it means the driver logs, dispatch records, and maintenance files a carrier is entitled to discard on a schedule unless a preservation demand arrives first. A Highway Patrol or Sheriff’s fatal-crash investigation, and any criminal case that follows, run on a separate track from the family’s civil claim, which does not wait for them and can succeed whether or not anyone is ever charged. On the damages side, the loss is proven with the person’s earnings history, the value of the work they did at home, and testimony about who they were to the people who depended on them.

A Wrongful Death Verdict the Defense Knows

The firm has recovered more than $100 million for California clients across verdicts and settlements. Separately, its results include a $21.1 million wrongful death verdict in a roadway-danger case against a public entity; every case is different, and prior results do not guarantee a similar outcome. Frequently Asked Questions About Carson Wrongful Death Claims

How long do I have to file a wrongful death lawsuit after a death in Carson?

Two years from the date of death for most claims, under CCP § 335.1. If a public entity is involved, such as Caltrans, the City of Carson, or Los Angeles County, a written claim is due within six months under Gov. Code § 911.2, and that shorter deadline controls. Courts rarely excuse a missed deadline.

Who can file a wrongful death claim in California?

The surviving spouse or domestic partner, the children, and, if there are no children, the heirs under California’s intestacy rules. Parents and stepchildren may join if they were financially dependent on the person who died.

Can we still recover if our family member was partly at fault?

Yes. California’s pure comparative negligence rule reduces the recovery by the person’s share of fault rather than barring it, and insurers routinely push fault onto the person who can no longer answer for themselves.

Is a criminal case against the driver required?

No. The civil wrongful death claim is independent of any criminal prosecution, and a family can recover whether or not charges are ever filed. A conviction can help prove fault, but its absence does not defeat the claim.

What is the difference between a wrongful death claim and a survival action?

The wrongful death claim compensates the family for its own losses. The survival action belongs to the estate and recovers what the person suffered before death, and it is where punitive damages are pursued; for a survival action filed on or after January 1, 2026, it no longer includes the person’s own pain and suffering. Most cases include both.

How much does it cost to hire Gammill Law?

You do not need to have the answers before you call. A free, confidential conversation with an attorney will tell you whether your family has a claim, who can bring it, and what deadlines apply.
