When a death in Gardena is caused by another person or company’s negligence, California law gives specified family members a wrongful death claim and gives the estate a separate survival claim, and both carry deadlines. Gammill Law Accident & Injury Lawyers is a South Bay trial firm that handles wrongful death cases for Gardena families. The firm has recovered more than $100 million for California clients across verdicts and settlements. Its results include a $21.1 million wrongful death verdict, a $16 million school sexual abuse verdict, and a $12 million whistleblower retaliation verdict; every case is different, and prior results do not guarantee a similar outcome.
A wrongful death claim is the civil case a family brings when a death was caused by someone else’s negligence or wrongful act. It is separate from any criminal case: a prosecutor decides whether to charge a driver or company, while your family decides whether to hold the responsible parties financially accountable. A family can recover whether or not a prosecutor ever files charges, and the claim values a loss the criminal system does not measure.
California limits who may bring a wrongful death lawsuit. Under Code of Civil Procedure § 377.60, the claim belongs to the surviving spouse or registered domestic partner, the children, and, if there are no surviving children, the people who would inherit under California’s intestacy rules. Parents and stepchildren can join if they were financially dependent on the person who died. If the statute does not list you, you cannot file, no matter how close you were.
California treats wrongful death as a single action, so every eligible relative should be part of one lawsuit, and someone left out can lose the right to recover. Our guides to who can file under CCP § 377.60 and when to file a wrongful death lawsuit in California cover the categories and the deadlines.
A death usually produces two separate claims.
The wrongful death claim belongs to the family. It compensates survivors for what they lost: the financial support and household services the person would have provided, funeral and burial costs, and the loss of their love, companionship, and guidance. California does not cap these damages in an ordinary negligence case.
The survival action belongs to the estate. Under Code of Civil Procedure § 377.34, it recovers the losses the person suffered before death, such as medical bills and lost earnings between the injury and the death. For survival actions filed on or after January 1, 2026, it no longer recovers the person’s own pre-death pain and suffering, because the temporary law that allowed it closed without extension. Where the conduct was especially bad, such as a drunk or grossly reckless driver, Civil Code § 3294 allows punitive damages through this claim.
A fatal crash in Gardena is investigated by the Gardena Police Department, the city’s own municipal force. Not every road here belongs to the city: the 110 and the 405 are Caltrans freeways at Gardena’s edges, and the State Route 91 designation runs through the city on Artesia Boulevard, which can change who is responsible. In 2021, the most recent year with complete crash reporting, traffic collisions in Gardena killed or injured 446 people, ranking the city 10th of the 105 California cities in its population group, according to the California Office of Traffic Safety’s 2021 crash rankings for Gardena.
Two years from the date of death. Under Code of Civil Procedure § 335.1, most wrongful death lawsuits in California must be filed within two years. The clock runs from the death, which can be a different date from the crash that caused it, and courts rarely excuse a missed deadline.
Six months when a public entity is involved. If a city vehicle, a public bus, a dangerous road, or a Caltrans freeway may have caused the death, your family must first present a written claim to the right entity within six months under Government Code § 911.2; if it is rejected, the deadline to sue is then six months from that rejection under Government Code § 945.6. Identifying the right entity matters: a Gardena city street or vehicle points to the City of Gardena, while the 110, the 405, and the State Route 91 stretch on Artesia Boulevard are Caltrans property. A Gardena case is filed and heard in the Southwest District at the Torrance Courthouse, 825 Maple Avenue.
Every wrongful death case answers three questions: what happened, whose fault it was, and what the family lost. The evidence rarely waits. In a crash case that means the vehicles before repair, event-data recorders, camera footage, and witnesses while memories are fresh; in a commercial-vehicle case it means driver logs, dispatch records, and maintenance files a company may discard unless a preservation demand arrives first. The loss is shown with the person’s earnings history, the value of the work they did at home, and the testimony of those who depended on them.
Trial reputation is leverage. Among the firm’s results is a $21.1 million wrongful death verdict, a Los Angeles County jury trial against the State of California over a highway crash cushion, reached after the defense offered $10,000 before trial; every case is different, and prior results do not guarantee a similar outcome. When the defense knows a firm will take a wrongful death case to a jury, settlement conversations change.
Gammill Law is a South Bay trial firm based in Torrance, and our attorneys bring more than 40 years of combined legal experience to every case we take. We prepare every wrongful death case for trial from the first meeting, and that preparation is why our settlements hold up.
We work on a contingency fee: nothing upfront, no hourly bills, and a fee only out of the recovery, under a written contingency fee agreement that complies with California law. If there is no recovery, you owe us no fee.
You work directly with an attorney, not a case manager. An initial consultation can be held by Zoom video, and we make home and hospital visits for families who cannot travel. We return calls, we explain things in plain English, and we do not push a family to decide before they are ready.
Two years from the date of death for most claims, under CCP § 335.1. If a public entity such as a city or Caltrans is involved, a written government claim is due within six months under Gov. Code § 911.2. Courts rarely excuse a missed deadline.
The surviving spouse or domestic partner, the children, and, if there are no children, the heirs under California’s intestacy rules. Parents and stepchildren may join if they were financially dependent on the person who died. The statute controls, not the closeness of the relationship.
Yes. California follows pure comparative negligence, so the recovery is reduced by the person’s share of fault rather than barred. Insurers push fault onto the person who can no longer answer for themselves; we answer with evidence.
No. The civil wrongful death claim is independent of any criminal prosecution, and a family can recover whether or not charges are filed. A conviction can help prove fault, but its absence does not defeat the claim.
The wrongful death claim compensates the family for its losses. The survival action belongs to the estate and recovers the losses the person suffered before death, and it is where punitive damages are pursued. Most cases include both.
Nothing upfront. We work on a contingency fee under a written agreement that complies with California law, and we are paid only out of a recovery. Our guide to what a personal injury lawyer costs in Torrance shows the fee math. If there is no recovery, you owe no fee.
