Carson Truck Accident Lawyer

Reviewed by David Gammill, California trial attorney · Last reviewed: September 24, 2026

If you were hurt by a commercial truck in Carson, your case will turn on the trucking company’s own records and on how many companies stand behind the driver, and the law puts a deadline on reaching them. Gammill Law Accident & Injury Lawyers is a South Bay trial firm that represents people injured in truck crashes in Carson and across the South Bay. The firm has recovered more than $100 million for California clients across verdicts and settlements. Its results include a $21.1 million wrongful death verdict, a $16 million school sexual abuse verdict, and a $12 million whistleblower retaliation verdict; every case is different, and prior results do not guarantee a similar outcome.

Why Truck Cases Are Nothing Like Car Cases

The physics are unforgiving: a loaded tractor-trailer can weigh many times what a passenger car weighs, and the people hurt worst are almost never in the truck. Whether the vehicle was a semi, an 18-wheeler, a big rig, a tanker, or a box truck, two things drive the case. First, the law is different. Interstate carriers operate under federal motor carrier safety rules that limit how long a driver may stay behind the wheel, require driver qualification files, set inspection and maintenance duties, and mandate drug and alcohol testing, and much of the proof lives in electronic logging device and engine control module data. A violation of those rules is often the heart of the case, not a technicality. Second, the insurance is different. Commercial policies are large enough to defend hard, and carriers keep rapid-response teams that can reach a crash scene the same day. Many trucks on Carson streets are running to and from the Ports of Los Angeles and Long Beach for a shipper, a broker, and a motor carrier that may all be different companies, which is part of why these cases take more untangling than an ordinary collision.

Who Can Be Held Liable in a Carson Truck Crash?

Truck cases usually involve a chain of companies, and California law lets an injured person pursue every link whose negligence contributed:

Which entity answers for a Carson crash follows the road: the City of Carson for its city streets, signals, and designated truck routes; Caltrans for the 405, the 110, and the 91; and the County of Los Angeles for a Sheriff’s Department vehicle or for roads in unincorporated West Carson and Rancho Dominguez. Delivery vans and box trucks raise the same questions with a twist, because the brand on the door is often not the company that employs the driver or carries the insurance; our Torrance delivery truck accident lawyer page covers how those claims are built.

The Evidence That Decides Truck Cases, and How Fast It Disappears

Truck cases are won in the records. The truck’s electronic logging device and engine control module capture driving hours, speed, and braking. The carrier holds inspection and maintenance files, dispatch and load records, the driver’s qualification file, and drug and alcohol testing history; in a drayage case that paper trail also includes the port terminal appointment and the chassis records for the container being hauled. Some of those records may lawfully be discarded on short retention schedules unless someone demands in writing that they be preserved. That is why the first thing we do in a truck case is send preservation letters to every company in the chain, before repairs, before salvage, and before the retention clocks quietly run out. The physical investigation runs alongside it: the vehicles themselves, the roadway, camera footage from businesses and interchanges that is overwritten within days, and witness accounts taken while memories are fresh.

Truck Traffic Is Part of Daily Life in Carson

Carson designates truck routes for commercial vehicles, including Wilmington Avenue, 223rd Street, and Walnut Street, among others, according to the Los Angeles County Public Works permit-authority compilation. The city’s identity is goods movement: a port-adjacent logistics city near the Ports of Los Angeles and Long Beach, with refining and warehousing along the 405, the 110, and the 91. That shows up in the traffic. On local roads near the 405, trucks were 2 to 24 percent of daily traffic in 2023, and on Wilmington Avenue, which is both a designated truck route and the heaviest drayage corridor, they were 16 to 24 percent, more than 2,500 truck trips a day, according to the regional freight data the county relies on.

The freeways are their own set of numbers. The 2023 Caltrans traffic census counts roughly 226,000 to 243,000 vehicles a day, both directions combined, on the 405 at the Wilmington Avenue interchange and 243,000 to 280,000 at the Alameda Street interchange, with Metro putting the segment’s total above 300,000; the 2022 Caltrans census put the truck share on the 405 through Carson at about 3 to 5 percent. Those freeway figures stay separate from the city’s local-road numbers and are never added to them. On the 405 between Wilmington Avenue and Main Street, a Metro study counted 4,335 injury collisions, including 201 severe injuries and 48 deaths, from 2019 through 2023; those are all-vehicle figures, not a truck count. Caltrans records for the same stretch show rear-end and sideswipe crashes were about three-quarters of all collisions, the congested weaving between closely spaced interchanges that heavy trucks have to drive in. Those freeway crashes fall under Caltrans and California Highway Patrol jurisdiction; on Carson’s city streets a crash is investigated by the Los Angeles County Sheriff’s Department at the Carson Sheriff’s Station, 21356 South Avalon Boulevard, because Carson is a contract city with no municipal police force.

What Compensation Can a Truck Crash Victim Recover?

California law lets an injured person recover economic damages, meaning documented losses like emergency care, surgery, rehabilitation, future treatment, lost income, reduced earning capacity, and vehicle damage, and non-economic damages, meaning the human losses: pain, disfigurement, and the activities an injury takes away. Where the evidence shows a carrier acted with conscious disregard for safety, such as knowingly keeping an unfit driver on the road, punitive damages may be available on clear and convincing proof under Civil Code § 3294; they are never automatic. When a truck crash takes a life, the family’s claim is a wrongful death claim with its own rules and its own deadlines, explained on our Carson wrongful death page.

The Deadlines That Control Your Carson Truck Case

Two years for most claims. Under Code of Civil Procedure § 335.1, most California injury and wrongful death lawsuits must be filed within two years of the crash, and courts rarely excuse a missed deadline.

Six months when a public entity is involved. If a Caltrans freeway, a city street or signal, a county road, or a government vehicle played a role, Government Code § 911.2 requires a written claim to the correct public entity within six months, before any lawsuit, and a rejection starts a further six-month clock to sue. In Carson that entity is usually the City of Carson for city streets, signals, and designated truck routes; Caltrans for the 405, the 110, and the 91; and the County of Los Angeles for a Sheriff’s Department vehicle or a road in unincorporated West Carson or Rancho Dominguez.

Where the case is heard. Carson sits in the South Central District of the Los Angeles Superior Court, so a Carson truck accident lawsuit is filed and tried at the Compton Courthouse, 200 West Compton Boulevard; since 2022 the court has kept new personal injury cases in their local district courts from filing through trial.

How Do I Find the Best Carson Truck Accident Lawyer?

Start with trial experience, because a trucking insurer prices a claim on the lawyer it expects to face in front of a jury. David Gammill has tried over 100 cases to verdict. Every case is different, and past results do not guarantee a similar outcome. Before representing injured people, he spent seven years as a Los Angeles County Deputy District Attorney, so he knows how the other side builds a case. Then ask two practical questions: who sends the preservation letters in the first week, before the carrier’s records can lawfully disappear, and will the lawyer who signs you up be the one who actually handles your case. At Gammill Law the answer to the second is an attorney, not a case manager, and the firm’s record is set out below so you can measure it against the first.

Why Truck Crash Victims Choose Gammill Law

Trial Results the Defense Knows

The firm has recovered more than $100 million for California clients across verdicts and settlements. Separately, its trial results include a $21.1 million wrongful death verdict in a roadway-danger case against a public entity; every case is different, and prior results do not guarantee a similar outcome. Carriers and their insurers price a case differently when the lawyer across the table is prepared to try it in front of a jury. See our case results.

Frequently Asked Questions About Carson Truck Accident Claims

How long do I have to file a truck accident lawsuit in Carson?

Two years from the date of the crash for most claims, under CCP § 335.1. If a public entity is involved, such as the City of Carson, Los Angeles County, or Caltrans, a written claim is due within six months under Gov. Code § 911.2, and that shorter deadline controls. The practical deadlines are shorter still, because a carrier’s records and nearby camera footage disappear on their own schedules.

Who can be held liable in a Carson truck crash?

Often several parties at once: the driver, the motor carrier, the shipper or cargo loader, a broker, a maintenance contractor, a manufacturer, or a public entity responsible for a dangerous road condition. In a port-drayage case that chain can also reach the terminal that loaded the container. Identifying every liable party, and every insurance policy, is a core part of the case.

What if I was partly at fault?

You can still recover. California’s pure comparative negligence rule reduces your compensation by your percentage of fault instead of barring your claim, and insurers exaggerate that percentage for exactly that reason. We push it back down with evidence.

What evidence matters most in a truck case?

The truck’s electronic logs and engine data, the driver’s hours and qualification file, maintenance and inspection records, dispatch and load documents, camera footage, and the vehicles themselves. Most of it sits in the carrier’s hands, which is why written preservation demands go out in the first week.

How much does it cost to hire Gammill Law?
